1940s SUPER, FASCINATING PRE INDEPENDENT STATE OF ISRAEL BRITISH LEGAL VOLUME PROVIDING SIGNIFICANT INSIGHT INTO THE BRITISH IMPLEMENTATION OF THE ENGLISH LEGAL SYSTEM REPLACING THE ELABORATE NOW DEFUNCT OTTOMAN EMPIRE'S LEGAL SYSTEM
8164On offer is a rare legal work that dates from the British Mandate for Palestine. The hard cover document measures 8.5 inches by 6 inches and contains 210 pages. It is 100% complete. The document is typed and is printed in both English and Hebrew. There are a number of typed inserts at various places in both the English and Hebrew sections. Although there is some staining on the pages, the typing is completely legible. All pages are intact with no pages or sections missing. However, the numbering begins with page 35. The index begins at page 35 as well. The book was the property of a Jewish judge, Dr. A Wachs. The book is entitled Supplementary No. 2 to the Palestine Gazette Extraordinary No. 978 of 15th January, 1940. In the opening paragraph titled Court Rules, the rationale for the Supplement is laid out: "IN EXERCISE OF THE POWERS VESTED IN HIM BY ARTICLE 19 OF THE PALESTINE ORDER IN COUNCIL 1922, AND SECTION 26 OF THE MAGISTRATES COURTS JURISDICTION ORDINANCE 1939, AND ALL OTHER POWERS ENABLING HIM IN THAT BEHALF, THE CHIEF JUSTICE HAS, WITH THE CONCURRENCE OF THE HIGH COMMISSIONER, MADE THE FOLLOWING RULES OF COURT" [p 35]. The book then goes on to delineate in great detail, the rules to be followed in the Magistrate's Courts in the British Mandate. On a number of pages, there are numerous typed notes inserted or attached to specific sections. These are almost exclusively in Hebrew. There are also extensive handwritten notes and marginalia. The civil Mandate administration was formalized at the League of Nations in 1923 under the British Mandate for Palestine. The Palestinian judicial system was unique because Palestine has been occupied and influenced by different powers and rulers for proceeding century. The result was an elaborate legal system. Obviously, much came from the now-defunct Ottoman Empire but large amounts were imported from Europe, especially the French legal system. On top of this was now added English common law. The British Mandatory administration, in keeping with the policy of Great Britain in administering its colonies, was anxious to introduce into Palestine the essentials of the English legal system. This volume is one part of that extensive exercise. For a legal historian, this is an excellent piece of the legal mosaic that formed the judicial foundation for the Palestine Mandate and the new State of Israel that would come into being in eight short years.
